• YOUR RIGHTS

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. OTHER THAN AS PERMITTED BY LAW, TILLER TIME DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE UNDER FEDERAL OR APPLICABLE STATE LAW.

• WARRANTY LIMITATIONS ARE SUBJECT TO CONSUMER LAW

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. TILLER TIME DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, TILLER TIME LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT TILLER TIME’S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

• WARRANTY COVERAGE

For ONE (1) YEAR from the date of your purchase of your Tiller Device, Tiller Time Pty Ltd of PO Box 94, FLINDERS LANE VIC 8009 AUSTRALIA (“Tiller Time”), warrants, only to you, Tiller Time’s USB-powered peripheral hardware (“Tiller Device”) against defects in materials and workmanship when used normally in accordance with the Tiller Device’s software instructions, which are located in the application. THIS WARRANTY ONLY COVERS THE PHYSICAL HARDWARE PURCHASED FROM TILLER TIME AND DOES NOT EXTEND TO ANY TILLER TIME SOFTWARE.

• WARRANTY EXCLUSIONS

Tiller Time does not warrant that the operation of the Tiller Device will be uninterrupted or without error. Tiller Time is not responsible for damage arising from the failure to follow the Tiller Device’s instructions.

This Warranty does not apply: (a) to any purchasers subsequent to the original purchaser; (b) to cosmetic damage, including but not limited to scratches, dents and normal wear and tear unless failure has occurred due to a defect in materials or workmanship; (c) to damage caused by accident, abuse, misuse, fire or other external cause; (d) to a Tiller Device that has been modified to alter functionality or capability without the written permission of Tiller Time; and (e) to damage caused by service performed by anyone who is not a representative of Tiller Time.

• HOW TO GET WARRANTY SERVICE

If the Tiller Device is not functioning properly, please begin the process of obtaining coverage by contacting  a Tiller Time representative at support@gettiller.com or at PO Box 94, FLINDERS LANE VIC 8009 AUSTRALIA, to help you determine whether your Tiller Device requires service, free of charge.

If your Tiller Device requires service, please securely package and mail your Tiller Device to “Tiller Time Pty Ltd” at PO Box 94, FLINDERS LANE VIC 8009 AUSTRALIA. You are responsible for the costs of shipping the Tiller Device to Tiller Time, including but not limited to packaging and postage. TILLER TIME IS NOT RESPONSIBLE FOR ANY DAMAGE CAUSED DURING SHIPMENT.

Tiller Time will conduct service and ship the Tiller Device within ten (10) business days of Tiller Time’s receipt of the Tiller Device.

This time may vary depending on volume, stock levels, and your location.

Tiller Time may, at its sole discretion, decide to service your Tiller Device by:

• repairing the Tiller Device using new or previously used parts that are equivalent to new in performance and reliability; or
• replacing the Tiller Device with the same model (or with your consent a product that has similar functionality) formed from new and/or previously used parts that are equivalent to new in performance and reliability.

Once service is complete, Tiller Time will return the Tiller Device to you. You are responsible for the return shipping costs, including but not limited to packaging and postage.

Replacement or repair of your Tiller Device does not restart the warranty period. The replaced or repaired Tiller Device’s Warranty runs from the date of the original purchase.

• YOU ARE RESPONSIBLE FOR YOUR OWN DATA

YOU SHOULD MAKE REGULAR AND ONGOING BACKUP COPIES OF YOUR DATA AS A SAFEGUARD AGAINST POSSIBLE DATA LOSS. TILLER TIME IS NOT RESPONSIBLE FOR ANY DAMAGES RESULTING FROM LOSS OF YOUR DATA.

• LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, TILLER TIME IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA AND INFORMATION.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

• GENERAL

No Tiller Time agent or employee has the authority to make any modification, extension, or expansion to this Warranty.

If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This Warranty is governed by and construed under the laws of the state in which the Tiller Device purchase took place. Tiller Time or its successor in title is the warrantor under this Warranty.

IMPORTANT: BY USING YOUR TILLER DEVICE YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE TILLER TIME ONE

Tiller Time Warranty - AU

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Tiller Time Pty Ltd (“Tiller Time”) of PO Box 94, FLINDERS LANE, VIC 8009, AUSTRALIA provides the following warranty in relation to its USB-powered peripheral hardware (“Tiller Device”).

The benefits of this warranty are in addition to any rights and remedies imposed by Australian State and Federal legislation that cannot be excluded. Nothing in this warranty is to be interpreted as excluding, restricting or modifying any State or Federal legislation applicable to the supply of goods and services which cannot be excluded, restricted or modified.


Warranty

Tiller Time warrants, subject to the exclusions and limitations below, that the Tiller Device will, for a period of 12 months from the date of purchase, be free from defects in materials and workmanship when used normally in accordance with the Tiller Device’s instructions, which are located in the software application. This warranty only covers the physical hardware purchased from Tiller Time and does not extend to any Tiller Time software.

If a defect appears in the materials or workmanship of the Tiller Device before the end of the warranty period and Tiller Time finds the Tiller Device to be defective in materials or workmanship, Tiller Time will, in its sole discretion, either:

• repair the Tiller Device; or
• replace the Tiller Device with the same model (or, with your consent, a product that has similar functionality).

Tiller Time reserves the right to replace defective parts of the Tiller Device with parts and components of similar quality, grade and composition where an identical part or component is not available.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

WARRANTY CLAIMS

• If a fault covered by warranty occurs, the customer must first contact a Tiller Time representative at support@gettiller.com or at PO Box 94, FLINDERS LANE, VIC 8009, AUSTRALIA to help you determine whether your Tiller Device requires service, free of charge.
• If your Tiller Device requires service, please securely package and mail your Tiller Device to:

• You are responsible for the costs of shipping the Tiller Device to Tiller Time, including but not limited to packaging and postage.
• Tiller Time is not responsible for any damage caused during shipment.
• Any warranty claim must be accompanied by:

• proof of purchase; and
• full details of the alleged defect.

• Once service is complete, Tiller Time will return the Tiller Device to you.

EXCLUSIONS

• You should make regular and ongoing backup copies of your data as a safeguard against possible data loss.
• Tiller Time is not responsible for any damages resulting from loss of your data.

LIMITATION OF LIABILITY

Except as provided in this warranty and to the maximum extent permitted by law, Tiller Time is not responsible for direct, special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to

• loss of use;
• loss of revenue;
• loss of actual or anticipated profits (including loss of profits on contracts);
• loss of the use of money;
• loss of anticipated savings;
• loss of business;
• loss of opportunity;
• loss of goodwill; loss of reputation;
• loss of, damage to, compromise or corruption of data; or
• any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property, any costs of recovering, programming, or reproducing any program or data or any failure to maintain the confidentiality of data and information.

Tiller Time makes no express warranties or representations other than set out in this warranty.
